TRIAL ATTORNEY OFFICE OF THE UNITED STATES TRUSTEE WILMINGTON, DELAWARE VACANCY ANNOUNCEMENT NUMBER 04-2010-001
About the Office: The Wilmington, DE Office for U.S. Trustees is seeking an experienced attorney from within the U.S. Trustee Program (USTP) to serve on a minimum six-month detail as a Trial Attorney. The Wilmington Office handles many of the largest and most sophisticated Chapter 11 filings in the United States and is seeking an experienced Trial Attorney to assist in these matters and to handle other creditor abuse and civil enforcement duties. The Trial Attorney position shall provide extensive practical experience litigating challenging and cutting edge legal issues in business reorganization cases against some of the nation’s most prominent and experienced bankruptcy professionals.
The USTP promotes the integrity and efficiency of the bankruptcy system by enforcing bankruptcy laws, providing oversight of private trustees, and maintaining operational excellence. The USTP carries out administrative, regulatory, and litigation responsibilities under titles 11 and 28 of the United States Code, and engages in significant enforcement efforts to combat fraud and abuse in the bankruptcy system.
Responsibilities and Opportunity Offered: The USTP employees who fill this position will:
• Provide advice and guidance to the AUST and UST on litigation strategy, evidentiary issues, procedural questions, discovery disputes, and other issues as they arise in the trial court and on appeal in cases assigned to the trial attorney..
• Prepare pleadings, discovery requests and responses, trial and appellate briefs, and other legal documents; conduct research of files and records; and assemble and correlate material to be used as evidence in the course of proceedings.
• Perform other administrative and legal duties as assigned.
Qualifications: Applicants must possess a J.D. degree, be an active member of the bar (any jurisdiction), and have at least seven years of post J.D. legal experience.
Applicants must have superior analytical and research skills; outstanding communications skills, both orally and in writing; a broad legal background; the ability to master new areas quickly; the ability to meet short deadlines and function effectively in time-sensitive situations; and proficiency in fostering and maintaining work relationships for the coordination and development of policy and procedures. Litigation experience and at least five years of extensive bankruptcy experience in chapter 11 cases is required, as well as five years of experience in consumer cases..
Location: This position is located in Wilmington, DE.
If the selected applicant’s duty station is more than 50 miles outside of the Wilmington, DE, area, he/she will be placed in an extended temporary duty travel (ETDY) status. A furnished apartment will be provided for the duration of the detail, and M&IE will be at a pre-determined reduced rate. One trip home per month will be authorized.
