We are discussing Miranda this week in my Constitutional Law class. From your end in the law enforcement arena, I am curious about your take on this issue.
"Miranda has been offered up as the solution to abusive police behavior. Has it worked? Do you have an alternative?"
There are three primary ways the society seeks to control police behavior: law; civil suits and complaints. As case law, Miranda has set the acceptable level of interrogation behavior for police. The police are punished for not following Miranda by having the statements made by the defendant ruled inadmissiable. So, as a control on some police interrogation behaviors, yet it has worked. As an alternative, well people could stop comitting crime.
